Antitrust Authority slaps Carige Insurance

Genoa - Carige Insurance has been fined €1 million. The sanction was decided by the Antitrust Authority, in order to combat, “unfair and aggressive business practices.” In the crosshairs of the regulatory agency are the measures put in place by the Insurer to recover its claims. “The misconduct,” said the authority, “was manifest in the systematic forwarding to consumers of court summons, to locations other than that corresponding to proper territorial jurisdiction. The summons also included a fictitious date for first hearing, without following due process. Specifically, it appears that thousands of consumers were sent notices, regardless of their residence, for the Milan court.”

According to the Antitrust Authority, “the practice was not aimed at exercising the legitimate right to recover the debt through the courts, but to exercise undue influence in the average consumer, with the intended consequence of making it appear preferable to provide the requested payment of the amounts, rather than going through the legal process. Summons sent for a different court from the territorial jurisdiction are considered, in fact, to exert psychological pressure on the recipients, such as the undue influence on consumer choices and behaviour.”
