Court proceedings resume with Schettino’s dismissal

Genoa - The case examining the termination of employment of former Captain of the “Concordia”, Francesco Schettino, resumes today in the Labour Court of Genoa. The Supreme Court decided the case should be tried here, not in Torre Annunziata (Naples), following an appeal by Mr. Schettino’s lawyer, Neopolitan Rosario D’Orazio, what is not clear is whether or not Costa Crociere will use the so-called “Rito Fornero” procedure, to which D’Orazio objected. “This procedure, created to speed up the processes in relation to dismissals,” writes the lawyer, “is yet to be introduced and the facts occurred almost three years ago. Furthermore there is a lack of response from the Supreme Court, notwithstanding the request for clarification on the issue urged by VI Civil Division of the Court and its most senior chairman. The obvious lack of consensus within the divisions of the court, itself, is proof of anomalies within our judiciary system”.
The lawyer also revealed that his client had a ruling in his favour in Torre Annunziata regarding the defence of Mr. Schettino, that had requested that costs of court proceedings be shouldered by Costa.
